Procedure to recover money mistakenly paid into wrong account

Due to mistake, carelessness and plethora of other factors, there are persons who will transfer or pay money into an account different from the one they intended to pay or transfer the money into.

Most times, individuals who find themselves in this type of quagmire tic situation usually resort to hopelessness and helplessness owing to palpable ignorance, and as such, they end up losing and forfeiting the money to either the bank or to the account they wrongly paid the money into. Francis Bacon, once said that knowledge is power, it is on the strength of that quote, that the writer will try to explain the procedure to recover money mistakenly paid into an account different from the one they intended.

The first step to take in this situation is to promptly inform the bank, either by writing, calling the customer care line, or by personally visiting the bank to explain the situation. But the ideal scenario will be to personally visit the bank, and explain the predicament viva voce. Once the predicament is explained to the bank, it then behooves on the bank to immediately reverse the money back to the transferor or the account the money was originally intended to be paid into.

Secondly, the bank on receipt of the complaint made by the transferor, will have to act quickly to correct the mistake, this the bank will do, by immediately reversing back the money to the transferor. This is only possible if the transferor and the owner of the wrong account are operating under the same bank. In this scenario, all the bank have to do is to either contact the owner of the wrong account, or sue moto reverse back the money to the transferor without the consent of the wrong account holder.

The third step to take will only be necessary, if the bank is unable to reverse back the money as explained in the last two steps. This may occur as a result of various factors such as; (1) when the transferor or and the owner of the wrong account is not operating under the same bank (2) when the owner of the wrong account refuses to give consent to reverse back the money to the transferor, (3) when the owner of the wrong account has moved the money into a different account and (4) when the owner of the wrong account has immediately withdrawn the money. In any of the aforementioned scenarios, the transferor will have to file an application to the court by way of motion on notice, praying for an order of court to reverse back the money to the transferor. However, with respect to where the wrong account holder has transferred the money into a different account or has withdrawn the money, the transferor will have to contact the police who will in turn approach the court to place a lien, in the form of posting no debit on the account of the wrong account holder. The application to the court by way of motion on notice will contain a supporting affidavit, wherein the transferor (Claimant) will state his/her account number, the name of the bank, the bank of the wrong account holder, plus the statement of account of the transferor and the wrong account holder.

The fourth and final step is for the transferor to obtain a certified true copy of the court order from the court registrar and then serve same on the bank. The bank on receiving the certified true copy of the court order will have no option but to reverse back the money to the transferor.

A pregnant teacher in Brazil died from COVID-19 after becoming infected at a surprise baby shower, her family said.

Camila Graciano, 31, had been careful to stay home because of a high-risk pregnancy, but came into contact with someone infected when her co-workers threw her a shower in Anapolis, Brazilian outlet Globo reported.

The guest wasn’t suffering symptoms at the time and unknowingly spread the virus to other partygoers.

“Unfortunately, my sister was one of the people who were infected,” Graciano’s brother, Daniel Helio Ambrosio, told the outlet, according to news station KRON.

Graciano, who was then eight months pregnant, was rushed three days later to the hospital, where she gave birth via emergency C-section, the outlets reported.

The baby girl was born healthy, but the virus-stricken mom remained in the hospital.

“After the birth, my sister showed significant improvement,” Ambrosio said. “The doctors even sent us a message saying, ‘Listen, have faith, because her lungs are improving, the heartbeat is improving (and) her blood pressure is improving.’”

But soon the new mom’s health began to rapidly deteriorate, and she was pronounced dead Aug. 22, the reports said.

Brazil has counted more than 121,000 deaths from the virus, which has sickened at least 3.9 million people, according to the latest figures from Johns Hopkins University.

Tiwa Savage, Don Jazzy Land In DSS Interrogation Room Over Social Media Posts About Buhari

Details have emerged on how Nigerian music producer, Michael Ajereh widely known as Don Jazzy, and Tiwatope Savage popularly known as Tiwa Savage, were invited by the Department of State Serviced for questioning over alleged political utterances against the administration of President Muhamamdu Buhari.

In recent months, following a sharp rise in sexual assault cases across Nigeria especially against women, Tiwa Savage began a movement known as “WeAreTired” in protest of the situation.

Through the movement, the musician called on Buhari’s administration to take action to stem the tide of rape in the country.

According to findings by SaharaRepoters, this in addition to several posts on social media calling on the government to live up to its responsibilities to Nigerians earned Tiwa Savage an invitation by the DSS.

Together with Don Jazzy, Savage was invited to the DSS office in Lagos two weeks ago during which they were warned to be careful with their posts on the social media.

Shortly after that episode, the two celebrities together with colleagues Yemi Alade and Waje were summoned by the Lagos State Commissioner of Police, Zubairu Muazu, who while sharing efforts they were making to tackle rape and other problems in the state and country, warned the musicians to steer clear of political comments in order not to incur the wrath of the President Buhari administration.

A member of Tiwa Savage’s management team, who confirmed the development to SaharaRepoters, said that the celebrated female artiste will not stop speaking for Nigerians regardless of any move by government.

But as if to confirm the subtle warning from governnent, Don Jazzy and Tiwa Savage both appear to have toned down their social media posts in recent days after the meeting with the DSS and police in Lagos.

For example, Don Jazzy, who is known to actively engage his numerous followers on social media, last posted anything on Twitter more than 22 hours while Tiwa never continued with her hashtag after the meeting with DSS Director at their Shangisha, Lagos office.

Apart from the two celebrities, the DSS has also invited a former deputy governor of the Central Bank of Nigeria, Obadiah Mailafia, over his comments on the operations of Boko Haram in the Northern part of Nigeria.

While speaking on a radio programme, Mailafia had stated that a serving governor in the North was the commander of Boko Haram.

He was invited twice for questioning by the DSS and also invited for interrogation by the police in Abuja, which he turned down by seeking a relief in court.

Paul Rusesabagina: Hotel Rwanda hero 'abducted in Dubai'

The daughter of Paul Rusesabagina, who was portrayed in a Hollywood film about the Rwandan genocide, has appealed for help to secure his release, saying she believes he was abducted from Dubai.

Rwandan officials said on Monday that Mr Rusesabagina had been arrested under an international warrant for leading “terrorist movements”.

Mr Rusesabagina’s daughter told the BBC the allegation was false.

Her father was a human rights advocate, Anaise Kanimba added.

Mr Rusesabagina, 66, is a strong critic of Rwanda’s President Paul Kagame.

The family last heard from Mr Rusesabagina after he landed in Dubai on Thursday, Ms Kanimba said.

He lived in exile, and was a US resident and a Belgian citizen, she added.

“So we would love these two places to help us get him home.

“The charges they have on him are baseless,” Ms Kanimba added in a BBC Newsday interview.

The Rwanda Investigation Bureau (RIB) paraded the arrested man in front of journalists in Kigali on Monday, but did not give details about where he was arrested.

It said Mr Rusesabagina had been the leader and sponsor of “extremist terror outfits”, and would be tried on charges of terrorism, murder, kidnap and arson.

Mr Rusesabagina, who is from the Hutu ethnic group, became well known after the 2004 film Hotel Rwanda depicted his efforts to save hundreds of Tutsis at a hotel where he was a manager during the 1994 genocide.

About 800,000 Tutsis and moderate Hutus were killed in the genocide.

They were killed by Hutu extremists who were forced from power by Mr Kagame and his Tutsi-dominated Rwandan Patriotic Front (RPF).

What else did his daughter say?

“We are not aware of how he got there [to Rwanda] and how this happened,” Ms Kanimba told the BBC.

“This is why we believe he was kidnapped because he would never go to Rwanda on his own will.”

She said the body language of her father following his arrest suggested that he was “staying strong and he doesn’t want us to know that he is beaten and even if they have him he’s going to show us that he’s going to continue fighting”.

Rwandan officials said on Monday that Mr Rusesabagina had been detained following “international co-operation”. Dubai’s government has not yet commented.

Why was he arrested now?

Mr Rusesabagina’s name featured recently in a terrorism case in Rwanda. The court heard allegations that a Rwandan rebel group, the National Liberation Front (FLN), had received help from Zambia’s President Edgar Lungu because of his close friendship with Mr Rusesabagina.

Mr Lungu’s spokesman denied the allegation in a BBC interview.

In 2011, Mr Rusesabagina was accused of funding subversion in Rwanda, but no charges were brought.

President Kagame’s critics accuse him of not tolerating any opposition. Several opposition leaders have been jailed and others fled into exile. The president says he is trying to prevent a return of ethnic hatred.

What is Hotel Rwanda about?

The 2004 film told the story of how Mr Rusesabagina, a middle-class Hutu married to a Tutsi, used his influence – and bribes – to convince military officials to secure a safe escape for an estimated 1,200 people who sought shelter at the Mille Collines Hotel in Kigali.

Don Cheadle played Mr Rusesabagina in the film.

Rwandan genocide survivors’ group Ibuka has in the past said that he exaggerated his own role in helping hotel refugees escape the 100-day slaughter.

In 2007, Mr Rusesabagina said a UN-backed war crimes court should put some members of the RPF on trial for their alleged role in the genocide.

“I’m just a normal person. But I’ve always defended human rights,” he said at the time.

“I’m trying to be the voice of millions of Rwandese who have no-one to speak out for them.”

Pope Francis renewed a call on Tuesday for the cancellation of debt owed by poor countries in the face of the coronavirus pandemic, saying it was time for restorative justice.

The pope is preparing for an audience with the public on Wednesday, his first since the pandemic hit Italy nearly six months ago.

“I repeat my call for the cancellation of the debt of the most vulnerable countries, in recognition of the severe impact of the medical, social and economic crises they face as a result of Covid-19,” the Roman Catholic Church’s highest official said.

“We also need to ensure that the recovery packages being developed and deployed at global, regional and national levels must be regeneration packages.

“It is a time for restorative justice.”

In April, the Argentinian-born pontiff called for debt to be reduced or cancelled in a message from an empty Saint Peter’s Basilica.

On Tuesday he said: “Policy, legislation and investment must be focused on the common good and guarantee that global social and environmental goals are met.”

The World Bank warned last month that coronavirus may have driven as many as 100 million people into extreme poverty.

The situation made it “imperative” that creditors reduce the amount of debt held by poor countries, the Washington-based institution’s president David Malpass warned.

Advanced economies in the Group of 20 have already committed to suspending debt payments from the poorest nations until the end of the year.

There is growing support for extending that moratorium into next year amid a pandemic that has already killed more than 840,000 people and registered 25.2 million cases globally.

Barcelona said on Tuesday they have agreed to sell Croatia midfielder Ivan Rakitic back to Sevilla.

Under the deal the southern side will pay the Catalan outfit 1.5 million euros ($1.8 million) plus nine million euros in variables for the 32-year-old, Barca said in a statement.

“FC Barcelona publicly express their gratitude to Rakitic for his commitment and dedication and wish him good luck and success in the future,” the statement added.

Rakitic, who had a year left on his contract at the Camp Nou, spent three seasons with Sevilla and won the Europa League in the 2013/14 season right before he made his big switch in 2014.

He was one of several Barcelona players who were reportedly told they were not part of new manager Ronald Koeman’s plans.

On Monday, Lionel Messi boycotted Barca’s first pre-season training session as the striker upped the stakes in his battle to leave this summer.

A former Minister of Aviation, Femi Fani-Kayode, has demanded that the management of Media Trust Limited – publishers of Daily Trust and other publications – enter into a negotiation with him for possible settlement of N6bn for defamation of character.

Fani-Kayode said this in a letter addressed to the Managing Director of Daily Trust, dated August 31, 2020 and titled, ‘Defamation of the character of Chief Femi Fani-Kayode by Iliyasu Gadu.’

The letter, which was signed by the former minister’s lawyer, Adeola Adesipe, was in response to an article titled, ‘FFK, the Drug Addled Thug in Designer Wears’ dated August 30, 2020 and published by the medium.

In the article, which was published in the newspaper, the writer lambasted Fani-Kayode for his conduct during a Press conference in which he described a Daily Trust reporter in Calabar, Eyo Charles, as ‘stupid’ after the journalist asked question about the identity of  persons “bankrolling” his current tour of southern states.

Gadu, the writer of the article, claimed that Fani-Kayode, who attended Cambridge University, was once “a drug addict” and had sought rehabilitation in Ghana, but “till today has not been cured of the habit.”

In his pre-litigation letter, however, Fani-Kayode described the article as libelous and demanded an apology from the newspaper, which must be published in other national dailies.

The former minister also demanded that negotiation be entered into for possible payment of N6bn due to the irreparable loss the article had caused him.

It reads in part, “Be aware that our client has not only suffered immeasurable loss of goodwill, he is currently confronted with unbearable opprobrium by his fans, followers and colleagues across the globe.

“Our client is alive to his rights both in law and equity but is disposed to an opportunity to undo the evil you have done by retracting the said insalubrious remarks on the same platform it was published and apologising to him in two other national dailies.

“You are also advised to enter into negotiations with us for the sum of N6bn being a token amount for penitence as opposed to the magnitude of infraction caused to our client’s nobility.”

The newspaper was given 14 days to comply or face legal action.

Fani-Kayode also wrote a similar letter to Gadu, who authored the article.

The former minister drew the ire of several Nigerians recently after a viral video showed him talking down at a journalist, an incident he has apologised for.

However, the Nigeria Union of Journalists, as well as many other civil organisations, have continued to criticise Fani-Kayode, while many reporters have boycotted his ongoing tour of the southern states.

President of the African Development Bank, Dr Akinwunmi Adesina, has been sworn-in for the second term in office.

The ceremony held virtually and was broadcast online on Tuesday.

The Chairperson of the AfDB board of Governors and Ghana’s Finance Minister, Kenneth Ofori-Attah, administered the oath of office.

Adesina, Nigeria’s former Minister of Agriculture and Rural Development, was re-elected on August 27, after getting a 100 percent vote of all regional and non-regional members of the Bank.

He is expected to serve another five-year term.

The globally renowned development economist, was first elected as President of the Bank on May 28, 2015.

He is the first Nigerian to be elected and re-elected to serve as the bank’s President.

The swearing-in ceremony was attended by Heads of States, Governors, and external stakeholders, according to a statement from the bank.

During Adesina’s first term, the Bank achieved impactful results on the lives of 335 million Africans, including: 18 million people with access to electricity; 141 million people benefiting from improved agricultural technologies for food security; 15 million people benefiting from access to finance from private investments; 101 million people provided with access to improved transport; and 60 million people gaining access to water and sanitation.

“The Bank has maintained its AAA-ratings by all major global credit rating agencies for five years in a row. The Board of Governors of the Bank Group approved a 125% increase in the General Capital of the Bank, raising its capital from $93 billion to $208 billion, the largest in the history of the Bank.

“The African Development Fund received a $7.6 billion pledge from donors, a 32% increase, for support to low-income countries and fragile states. The Bank was ranked the 4th most transparent institution globally by Publish What You Fund, bolstering its strong governance credentials for transparency and accountability.

“The African Development Bank’s Board of Directors approved a $10 billion facility to support African countries to address the COVID-19 pandemic. The Bank also launched a $3 billion COVID-19 social bond on the global capital markets, the highest US dollar denominated social bond ever in world history, which is listed on the London Stock Exchange, Luxembourg Stock Exchange and NASDAQ,” the statement added.

The African Development Bank is Africa’s premier development finance institution, comprising 54 regional and 27 non-regional member countries.

The Senate said on Tuesday that none of its members received N20m COVID-19 palliative from the Niger Delta Development Commission.

The Director of Projects, Interim Management Committee of the NDDC, Dr. Cairo Ojougboh, had alleged in a recent newspaper interview that the agency gave N20m to each senator while each of the House of Representatives member collected N15m as palliative.

But the Spokesperson for the Senate, Dr. Ajibola Basiru, denied Ojougboh’s claims in a statement titled, “NDDC boss says senators got N20m, reps N15m each for COVID–19 – a disclaimer,” on Tuesday.

Basiru challenged Ojougboh to either release the full list of the lawmakers who benefitted from the palliative or tender a public apology immediately.

The statement read in part, “The Senate views with grave concern a statement credited to Dr Cairo Ojougboh, the Executive Director, Projects of the NDDC who alleged that National Assembly members received varying sums of money as COVID-19 palliative.

“The Senate hereby disclaims the allegation in its entirety.

“The Senate categorically denies that any Senator collected the sum of N20 million or any sum whatsoever from NDDC as COVID relief fund of for any purpose whatsoever.

“The Senate challenges Dr Ojougboh to publicly provide evidence of his claim and list the names of the Senators he allegedly gave the alleged sum.

“Failure to provide evidence of his claim, the Senate hereby demands an immediate retraction and a public apology from Dr Cairo Ojougboh.”

President Muhammadu Buhari’s closest aide and Senior Special Assistant on Domestic Affairs, Sarki Abba, has tested positive for Coronavirus.

According to SaharaReporters, Abba tested positive for the virus two weeks ago and had not been seen on the Presidential Villa since then.

A source in the Presidency said those, who came in contact with him had also been asked to self-isolate.

The source said the current status of Abba remains unknown weeks after.

“Abba tested positive for COVID-19 two weeks ago but his current status as we speak is unknown, whether he has tested negative or not.

“All I know is there’s conspiracy of silence with regards to his status,” the source said.

Part of Abba’s duties before testing positive for COVID-19 was to come out to pick visitors when they arrive the Presidential Villa to see President Buhari.

He also adjusts the President’s seat and moves with him everywhere.

Recall that in April, another close aide and Chief of Staff to President Buhari, Abba Kyari, died of Coronavirus complications.

A key member of the Buhari’s administration, his demise sent panic across Nigeria’s seat of power, forcing drastic safety measures to be adopted to protect the President, who has himself battled an undisclosed ailment and had visited UK several times in recent years for medical attention.

SaharaReporters in August exposed how Mamman Daura, a nephew of the President was flown abroad for urgent medical treatment.

Daura was flown in a private jet to the UK after exhibiting respiratory difficulties with symptoms similar to Coronavirus.

He made the trip at a time the ban imposed on international flights to curtail further spread of COVID-19 in Nigeria had not been lifted.
